Effective Date: Febuary 17, 2025
This Terms of Service agreement ("Agreement") governs your participation in regular meetings, tournaments, and other activities organized by the Oceanside Chess Club (referred to as "the Club," "we," "us," or "our"), a Canadian registered nonprofit organization based in British Columbia, Canada. By engaging with the Club, you agree to comply with the terms outlined in this Agreement. Failure to adhere to these terms may result in the denial of participation or other actions as determined by the Club.
1. Regular MeetingsRegular meetings of the Oceanside Chess Club are held on Saturdays. By attending these meetings, you agree to the following:
- Be considerate of other players and maintain a respectful environment.
- Do not damage or misuse the Club's property. If any property is damaged as a result of your actions, you are responsible for its replacement or repair.
- Disrespectful or abusive behavior will not be tolerated. The Club reserves the right to deny entry or participation to any individual for any reason.
The Club maintains an opt-in local rating system to track a player's games, results, and performance. If you choose to participate in our local rating system you agree to the following:
- The Club, at the discretion of the Board of Directors, may nullify, disqualify, or change the result of a reported game for any reason.
- In the event of a dispute regarding game results, the Board of Directors is responsible for reaching a determination. The decision of the Board shall be final and not subject to dispute.
- The Club reserves the right to deny a player access or acceptance into the local rating system or remove a player from the rating system at any time and for any reason.
The Club is not responsible for any damages to the building, equipment, or personal property. By participating in Club activities, you acknowledge and agree to the following:
- The Club will hold lost items until they can be returned, but this is not a guarantee. It is your responsibility to ensure you have all your property with you.
- Any damages to equipment, personal property, the property of others, or the building is not the responsibility of the Club.
All logos, images, and media used by the Club are the intellectual property of the Oceanside Chess Club. Redistribution, storage, transmission, or display of this material is strictly prohibited unless prior written permission is granted by the Board of Directors.
5. Tournament Rules and ConductBy registering for a tournament, you agree to the following terms:
- By registering for this tournament, you expressly acknowledge and agree to be legally bound by the terms and conditions set forth in the waiver of liability. You further agree to fully adhere to and comply with the waiver throughout the duration of the tournament. This document constitutes a legally binding agreement that affects your legal rights, including, but not limited to, your ability to persue legal action. Please read this document carefully and in its entirety before proceeding with registration.
- You must complete the registration form completely and to the best of your ability. Providing false or incomplete information may result in disqualification.
- Payment for tournament registration fee must be made in cash or by e-transfer unless otherwise specified by the Board of Directors prior to registration. All payments must be received at least ten (10) days before the tournament start date.
- Offensive or inappropriate clothing is not permitted during tournaments. The Club reserves the right to deny entry to any participant whose attire is deemed unsuitable.
- You must be legally and physically capable of attending the tournament to register. By registering, you confirm that you meet these requirements.
- It is your responsibility to arrive at the prescribed time. Failure to do so may result in ineligibility to play or a recorded loss of one or more of your games while absent.
- The Club reserves the right to deny a player's registration or entrance at any time and for any reason.
- Any disputes regarding game results, clock usage, or other matters will be settled by the arbiter. The arbiter's ruling may only be overruled by the Event Director or a 60% vote by the Board of Directors. If the Tournament Director and Board of Directors do not agree, the decision of the Board of Directors shall take precedence. Such rulings shall exist with prejudice and cannot be disputed for the remainder of the tournament.
- Players may be photographed during tournaments. If you do not wish to be photographed, you must inform the Club in advance. For more information, refer to our Privacy Policy.
- If you are unable to attend a tournament or are disallowed attendance within 10 days of the event, the Club is under no obligation to provide reimbursement or refund.
- Prizes awarded to winners will be paid by check and must be accepted within one (1) month of being awarded. Failure to accept a prize within this timeframe will result in forfeiture.
To ensure a fair and respectful environment, the following behaviors are strictly prohibited during tournaments:
- Cheating or violating tournament rules.
- Disruptive or disrespectful behavior toward players, arbiters, or staff.
- Use of electronic devices without prior approval from the arbiter.
- Unauthorized recording or transmission of games.
This Agreement is subject to change without prior notice. It is your responsibility to review this Agreement regularly to ensure you understand and comply with the current terms.
8. Governing LawThis Agreement is governed by the laws of British Columbia, Canada. Any disputes arising from this Agreement shall be resolved in accordance with these laws.
By interacting with the services of the Oceanside Chess Club, you acknowledge that you have read, understood, and agreed to this Agreement and our Privacy Policy.
